Welcome to NeighborNation.net! Sustain Dane Inc. provides NeighborNation.net to you, subject to the following Terms of Service which may be updated by us from time to time without notice to you. By accessing, viewing, or using NeighborNation.net, you indicate that you have you have read, understand and agree to the Terms of Service.

By agreeing to the Terms of Service for NeighborNation.net you agree unconditionally to release Sustain Dane Inc., its officers, directors, employees and agents from any and all liability whatsoever resulting from, pursuant to, or connected with such listing and any future transactions resulting there from. Information provided through NeighborNation.net is supplied by the lister of the material, not Sustain Dane Inc. its contractors or sponsors, nor is any advisor, agent, or employee liable or responsible for any warranty, expressed or implied, as to the accuracy of the material description, the suitability for a particular use, or the salability of any material offered through this service. Neither Sustain Dane Inc. its sponsors nor any advisor or employee thereof is liable for any information, error, or representation, nor makes any warranty, expressed or implied, as to the accuracy or quality of any information, service, or product/equipment offered through NeighborNation.net.

Description of Service

Sustain Dane provides access to a public online kiosk, NeighborNation.net, for neighbors to share or seek items, offer or find services, or form or join a group.

Definitions

Administrators - Administrators are Sustain Dane Inc. staff which manage NeighborNation.net. Administrators can, but are not obligated to, manage NeighborNation.net operation which includes but is not limited to setting permissions, banning users who don't comply to the terms of service and creating moderators.   Administrators also have the same the capabilities as moderators defined below.

Moderators - Moderators are individuals (or groups of individuals) who can, but are not obligated to, look after the neighborhood postings from day to day. Moderators have the capabilities to edit or delete posts and lock, unlock, move, and delete posts in the neighborhood they moderate. Sustain Dane Inc. designates moderators to assist in preventing people from posting abusive or offensive material and to help the neighborhood to have a person to contact with their neighborhood specific issues. Typically moderators are active community members whom live in the neighborhood they are designated to moderate.

Modification of Service

Sustain Dane Inc. reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, NeighborNation.net (or any part thereof) with or without notice. Your continued use of NeighborNation.net after the posting of any amended Terms of Service shall constitute your agreement to be bound by any such changes. You agree that Sustain Dane Inc. shall not be liable to you or to any third party for any modification, suspension or discontinuance of the NeighborNation.net.

BE LIABLE TO YOU FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL , INCLUDING LOSS OF PROFIT , LOSS OF USE OR OTHER FINANCIAL LOSS , ARISING FROM OR RELATED TO YOUR USE , MISUSE OR INABILITY TO USE NEIGHBORNATION.NET , WHETHER SUCH DAMAGES ARE   BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY.   YOU EXPRESSLY UNDERSTAND AND AGREE THAT SUSTAIN DANE INC. SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, INCLUDING DEATH, CAUSED BY OR ARISING FROM YOUR USE , MISUSE OR INABILITY TO USE ANY I TEM OF INFORMATION OR ANY PRODUCTS OR SERVICES OR ANYTHING ELSE OBTAINED ON OR THROUGH NEIGHBORNATION.NET.

Users' Rights and Privileges

As a user, the NeighborNation.net service may be used to post information about items and services the user is willing to share, sell, give away or exchange with others within their neighborhood. NeighborNation.net users shall not exploit the NeighborNation.net site as place to conduct commercial business.

Each user is allowed to self-select a password and account designation upon completing the registration. Users are responsible for maintaining the confidentiality of their password and account, and are fully responsible for all activities that occur under their password or account. If there is any unauthorized use of your password or account or any other breach of security, you shall notify Sustain Dane Inc. immediately.

Postings

Sustain Dane Inc. will not allow certain content in the title and/or description posted on NeighborNation.net. When using the NeighborNation.net service, the users agrees to the postings limits as set forth in the Ground Rules, which may change periodically and to other items relating to the postings as amended to the Terms of Service.

When using NeighborNation.net the user may not:

• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
• Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information.
• Include any topic, name, material or information that incites discrimination, hate or violence towards one person or a group because of their belonging to a race, a religion or a nation, or that insults the victims of crimes against humanity by contesting the existence of those crimes.
• Impersonate any person or entity.
• Interfere with or disrupt the Sustain Dane Inc. servers or networks connected to Sustain Dane Inc., or disobey any requirements, procedures, policies or regulations of networks connected to NeighborNation.net.
• Intentionally or unintentionally violate any applicable local, state, national or international law.
• Collect or store personal data about other users.
• Post material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others.

If a Sustain Dane Inc. staff member or its designees determines that the content of a post is violating the Terms of Service, Sustain Dane Inc. reserves the right, but is not obligated to edit, delete, modify or refuse a posting or a user account, including deleting the user account with or without notice.

Link Sites

The user agrees that Sustain Dane Inc. shall not be responsible or liable, directly or indirectly for any services, items or anything else that may be obtained, damaged or loss caused by or in connection with the use of a link to other World Wide Web site or resource through NeighborNation.net.

NeighborNation.net Privacy Policy

Sustain Dane Inc. does not rent, sell, or share personal information about you with any organizations or individuals. All information submitted through the login page will be kept confidential. In the event that Sustain Dane Inc. is requested for information for lawful purposes, Sustain Dane Inc. will conform with legal authorities.

Area of Service

Users of NeighborNation.net agree that the service shall only be used within the United States of America.

Right to Use Content

You agree that upon posting information on NeighborNation.net, you grant and assign Sustain Dane Inc. and a non-exclusive, worldwide, royalty-free, perpetual, non-revocable license to use, distribute, display, reproduce, and create derivative works from such material in any and all media, in any manner, whole or part, without any duty to account to you.

Registration Obligation

In consideration of your use of NeighborNation.net you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to provide true, accurate, current and complete information about yourself as prompted by NeighborNation.net's registration form. If you provide any information that is untrue, inaccurate, not current or incomplete, or Sustain Dane Inc. has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Sustain Dane Inc. has the right to suspend or terminate your account and refuse any and all current or future use of NeighborNation.net.

No resale of NeighborNation.net .

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of NeighborNation.net, use of NeighborNation.net or access to NeighborNation.net.

Proprietary rights of Sustain Dane Inc.

You acknowledge that the NeighborNation.net service provided by Sustain Dane Inc. contains proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by Sustain Dane Inc, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on NeighborNation.net.

Legal Forum

You and Sustain Dane Inc. agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Dane, Wisconsin. The Terms of Service and the relationship between you and Sustain Dane Inc. shall be governed by and construed in accordance with the laws of the State of Wisconsin.

Violations

Please report any violations of the Terms of Service to Sustain Dane Inc.
